Its an issue for which patch is available, jboss actually deploys porltets in lexicographical order, so the first portlet that deploys before ROOT.war will cause Exception,
you can raise a support ticket, patch might be readily available for it.

We are using 6.0-ee-sp2 with jboss-5.x, even we were facing the same problem, but by applying the patch the issue was resolved as expected.

Since you have the EE version, just contact liferay for support. You've paid for it.

BTW, don't create a new bug issue. If you mean a support ticket, do by all means.
